01The Services

The Website and Services enable you to design and operate interactive landing pages and engagement experiences such as surveys, quizzes and reveal mechanics.

To use the Services, you may be required to register an account. You agree to provide complete and accurate information and keep it current so we can contact you about inquiries, complaints, updates and other matters concerning your use.

You are forbidden from using aliases or other means to mask your true identity or contact information during registration or thereafter. We may limit your access until we verify your account information.

You are solely responsible and liable for all activity under your account. You are fully responsible for maintaining account security, including keeping your password secure. We are not liable for any acts or omissions by you, including any damages resulting from your acts or omissions. You must not share or misuse access credentials and must immediately notify us of unauthorised account use or security breaches. If we believe your account is compromised, we may suspend or disable it.

If you choose to implement monetisation on your landing page, that decision is entirely at your discretion and subject to terms with your chosen service provider. The monetisation service is operated by an independent third party. You are solely responsible for complying with their procedures, requirements and obligations. We are not involved in the provision, management or oversight of the monetisation service and assume no responsibility for your monetisation activities.

We may accept, reject or discontinue your registration at any time in our sole discretion with or without reason or notification.

Any complaint, objection, disagreement or claim related to your use of the Services must be submitted within five (5) calendar days from its occurrence. We reserve the right to reject or disregard any complaint submitted in delay.

We reserve the right, at any time and our sole discretion without notice or liability, to discontinue, modify or alter any part or the entire Website and/or Services.

If in our sole discretion you fail to comply with these Terms, we may immediately terminate these Terms, your password and user account, access and use of the Website and Services, and withhold any account balances, without notice, responsibility or liability to you.

You understand and agree that third-party services may be enabled, provided, purchased, and third-party terms and conditions may apply when you leave the Website and/or when using the Services and Content. These Terms apply to the Website and Services only, not to any other website or services owned or operated by any other person or entity.

You understand and accept that we do not examine, endorse or control, and we have no responsibility for the availability or provision of any external website, services, links or resources of any third party, nor for any content, advertising, products or other materials on or available from such websites, services, links or resources.

We make no representations or warranties whatsoever regarding any websites, services, links or resources owned, operated or provided by third parties. Any use of third-party websites, services, links or resources is at your own risk.

Any concerns or inquiries with respect to any other website or services shall be communicated and directed to the operator, administrator or webmaster of such website and service.

03Parties Rights and Licenses

We grant you a non-exclusive, non-transferable, limited right to access and use the Website, Services and Content, unless otherwise specified, only for the purposes of designing and operating interactive landing pages and engagement experiences, provided that you comply fully with the provisions of these Terms.

You acknowledge that the Website and Services may contain information, videos, photos, software, graphics, text, music, sounds, questions, creative suggestions, comments, messages, feedback, ideas, notes, drawings, articles and other materials (collectively, "Content") that are protected by copyrights, database rights, trademarks, patents, trade secrets and/or other proprietary rights.

All copyrights, access rights and rights of use of the Website, Services and Content incorporated therein are expressly reserved.

These Terms do not transfer any of our or third-party intellectual property to you and all rights, title and interest in such property remains solely with their respective owners.

04Prohibited Use

You hereby acknowledge and accept that we adopt and act in our discretion upon the following non-acceptable business rules for users, which include without limitation: (a) where there are known or perceived links to terrorist organisations, military, arms and/or ammunition manufacture or sales; (b) where there is knowledge or suspicion of money laundering or terrorist financing; (c) where it is known or there are reasonable grounds for suspicion that a criminal offence has taken place; (d) where you and/or your associated parties are subject to any sanctions measures; (e) where there is knowledge or suspicion of an activity or trade within, from or into a country where that activity is subject to embargo and/or trade control restrictions; (f) where there is involvement with any racist, pornographic, pressure group or extremist organisations; (g) unregulated or regulated entities that do not have the appropriate licensing; (h) political organisations.

In addition to other prohibitions as set forth in these Terms, you are prohibited from using the Website, Services or Content for any unlawful purpose, to cheat or defraud, to violate any applicable laws, to infringe intellectual property rights, to harass or discriminate, to submit false information, to upload viruses or malicious code, to collect personal information of others, to spam, to interfere with or circumvent security features, or to exceed your permitted access and use of the Website and Services.

We reserve the right to terminate your access and/or use of the Website and/or Services upon our suspicion of or your actual engagement in any of the prohibited uses.

You represent and warrant, among other things, that: you have the right and authority to enter into this agreement; your use will be in strict compliance with these Terms; you will comply with all applicable laws and regulations; you and your website(s) and/or landing page(s) are not involved in any illegal activities or in any deceptive, misleading or fraudulent practices; you are fully responsible for the content available on your website(s); your website(s) do not contain or promote libellous, defamatory, abusive, violent, prejudicial, obscene, infringing, sexually explicit or illegal content; you own or have legal rights to all content displayed on your website(s); and you will not reproduce, duplicate, copy, sell, resell or exploit any portion of the Website, Services or Content without our express written permission.

In any case where you are in breach of any representation and warranty under this clause, we reserve the right to refuse, suspend or cancel your access to and use of the Website, Services or Content at any time without explanation, warning or notification.

06Data Protection

We are fully committed to protecting your security and privacy. All personal data that we collect from you will be processed in accordance with our Privacy Policy, which is incorporated into these Terms.

You hereby agree that your website(s) and/or landing page(s) comply with all applicable regulations to protect users' privacy and data, including the UK GDPR, the Data Protection Act 2018 and the EU GDPR.

07Limitation of Liability and Disclaimer of Warranties

The Website, Services and Content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we and our third-party service providers expressly disclaim all warranties of any kind, whether express or implied, including without limitation any warranties for non-infringement, satisfactory quality, merchantability, fitness for any particular purpose, durability and title.

We do not guarantee, represent or warrant that your access and use of the Website, Services and Content will be continuous, uninterrupted, timely, secure or error-free.

09Termination

We reserve the right at any time to unilaterally terminate these Terms and stop your access and/or use of the Website and/or Services with immediate effect, for any reason whatsoever or without a reason, without any prior notice or liability to you.

Your obligations and liabilities incurred prior to the termination date shall survive the termination of these Terms for all purposes.

10Force Majeure

Circumstances beyond our control, including force majeure events such as power or server outages, maintenance periods, war, Acts of God, natural disasters, pandemics, terrorist attacks, government actions, labour disputes or utility failures, may necessitate substitutions, alterations, postponements, failures, delays, unavailability or cancellations to the operation of the Website, Services and Content. 11Governing Law
